La mediación comunitaria como mecanismo alternativo para la solución de conflictos jurídicos en el Ecuador

Abstract
El presente artículo científico examina la mediación comunitaria en el Ecuador desde un enfoque técnico-jurídico, considerando su funcionamiento frente a la congestión del sistema judicial ordinario. Su propósito es determinar la efectividad práctica de este mecanismo y analizar los principales vacíos normativos que inciden en su reconocimiento como título de ejecución. Para ello, se adoptó un enfoque cualitativo con diseño documental, mediante la revisión y organización de fuentes doctrinales y de la normativa vigente.
Los resultados indican que, aunque el artículo 47 de la Ley de Arbitraje y Mediación otorga al acta de mediación el valor de sentencia ejecutoriada con efecto de cosa juzgada, en la práctica su aplicación presenta dificultades en términos de seguridad jurídica. Estas limitaciones se relacionan con la ausencia de facultades coercitivas del mediador y con deficiencias técnicas en la elaboración de las actas, lo que, en casos de incumplimiento, conduce nuevamente al sistema judicial ordinario.
Se concluye que el fortalecimiento de la mediación comunitaria requiere no solo la formación especializada de sus operadores, sino también la implementación de mecanismos de seguimiento posteriores a los acuerdos, a fin de garantizar una tutela judicial efectiva, mayor agilidad procesal y reducir la necesidad de ejecución forzosa.
